What is Chapter 13 Bankruptcy?
Chapter 13 bankruptcy is a debt repayment plan. It allows you to protect your home from foreclosure while you catch up on past-due payments. It also allows you to reduce additional debts by making reduced payments over a 3 to 5 year period.
Chapter 13 is often the best option for wage earners, as it allows you to protect your assets and equity in your home that would not be protected under Chapter 7.
Repayment Plans
When you file under Chapter 13, you will set up a court-approved payment plan to pay a percentage of your debt. Upon successful completion of the plan, your remaining eligible debt is discharged. Some debts, such as student loans, past due child support, and tax debt cannot be discharged.
