What is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy is sometimes referred to as liquidation. A Chapter 7 filing may eliminate a majority of your debts. However, you may have to sell some of your property to pay your creditors.
The Means Test and Eligibility for Chapter 7
Since October 2005, individuals who wish to file for Chapter 7 must meet eligibility requirements based on a "means test." This test was put in place primarily to prevent high income debtors from filing for Chapter 7.
Credit Counseling and Debtor Education
The new bankruptcy laws require people who wish to file for either Chapter 7 or Chapter 13 to complete an approved credit counseling program prior to filing a petition. They must also obtain debt management counseling from an accepted source before the bankruptcy process is completed.
