For example, a client may have purchased a home, taking out a $500,000 mortgage. In today's market the house is now worth far less and because of job loss or other reason, the homeowner is unable to make the payments. The owner puts the house up for sale, but could only sell it for $400,000 and does not have the money to make up the $100,000 difference to the lender.
In a short sale, the lender agrees to accept the proceeds of the sale, whatever they may be, and release the lien. For the client, this is a better way to sell their home rather than going through foreclosure. It is usually a better option for the lender as well.

Filing for Chapter 13 can prevent home foreclosure. If you successfully make payments under your Chapter 13 repayment plan, you can remain in your home.
